Terms and Conditions

The terms and conditions below are applicable to all villa rental reservations made through websites owned and operated by SIMBA GROUP.

ARRIVAL AND DEPARTURE TIMES

The designated check in time is 3:00pm, with a check out time of 12:00pm (noon), unless other arrangements have been made and agreed upon by the Lessor. Any early arrivals or late departure times are subject to the availability of the villa, and will impose extra fees.

PAYMENT :

When the guest makes a booking request of villa, the guest must make the appropriate full payment in advance and this payment is non-refundable to Villa Deh Simba.

PAYMENT METHODS

 

FULL payment is required to secure your booking. Your booking confirmation must be made by email or telephone (followed by written confirmation) and will be held provisionally for five days within which the payment has to be received into our account. Payments can be made by either online payment or bank transfer. The issued INVOICE shall explicitly mention the amount due and full payment. We have two different payment methods available. You can choose the one which is easiest in your situation.

  1. Wire Transfer. International telegraphic transfer to our corporate bank account normally takes about three days. The amount transferred must include telegraphic transfer fees. If you choose to settle your payment by bank transfer, make sure that you allocate sufficient time before the due date and to mention “Full Amount Guarantee” when you submit the transfer instruction.
    In the case you are aware that your transfer payment may not reach our account in time, promptly notify us by sending (either emailed scan or fax) your transfer instruction receipt. Make sure that the receipt has bank’s authorization print-out. We have to receive the payment in full into our account. In the case arriving payment is slightly less than required in the INVOICE because of transfer fee, bank’s charge, currency loss, etc. you are required to pay the remainder either along with your final payment (if you are paying deposit) or in cash upon arrival.
  2. Online Payment with Credit Card by Visa or Master. Online payment is the simplest and quickest way to settle your bill. Payment by credit card will be subject to 3.5% of credit card processing surcharge  and will be charge in Indonesian Rupiah (IDR). Refer to Indonesian banking regulation requires all credit card transaction has to be made in Indonesian Rupiah. Therefore if you choose to pay by credit card, you will get your invoice pre-converted into Rupiah, refer villa’s prevailing exchange rate. We will send you a link which will direct you to online form where you will have to fill in your credit card details. It will be processed by BCA PAYMENT GATEWAY under PT. EDY MALENA ENTERPRISES as the online payment gateway and it will shown in your billing statement.

Reservation Voucher

Once the full payment is received, the Guest shall be sent a reservation voucher by Villa Deh Simba with confirmation details, the Property’s address, contact details of the Villa Deh simba representative, and directions to the Property. This voucher, along with the Guest’s passport, needs to be presented upon arrival for check-in.

Additional Costs

The cost of electricity, mains, water, cleaning and garden supplies and local taxes are included in rental rates.

There are generally no additional costs, surcharges, taxes, staff salaries, or management fees above the price quoted unless otherwise stated in the property description, the guest booking confirmation or reservation voucher.

DAMAGES & LOST PROPERTY

We reserve the right to charge the lead guest for any damages caused through the course of a booking by any member of the booking party. This includes breakages, spillages, stains, damage to furniture or fixtures and fittings. Any accidental damages should be reported as soon as possible in order to minimize damage and associated costs. Lost keys / fobs / access cards will incur a replacement charge per key / fob / card lost.

Any lost property, if discovered and found, left behind by guests during a stay will be held for a period of 1 month. While we will make our best efforts to reunite lost property with their owners we accept no responsibility in replacing lost items and encourage guests to ensure they have all their belonging before checking-out. We may offer to post lost items via recorded delivery at the cost of the property owner, otherwise collection can be arranged.

PETS POLICY

Pets of any kind are NOT allowed in or on the villa’s premises. A pet, or evidence of a pet, found on premises will cause immediate eviction, and the client\’s rent and deposit will be forfeited to cover the costs of professional cleaning the carpets and furnishings etc.

NON SMOKING POLICY

All of our rooms are designated non-smoking. Smoking is only allowed in Outside area room. We apologize for not giving any tolerance on this policy.

DRUGS & HAZARDOUS MATERIALS

 

Client and members of his party shall not use or permit to be brought into any villa any illegal substances, inflammable fluids or other explosives or articles deemed hazardous to life, limb or property.

LIABILITY

 

No liability is accepted by the owner for death, personal injury, accidents, loss or damage to persons or personal effects however caused as a result of the use of the villa or pool.

The owner cannot accept liability or pay any compensation where the performance or prompt performance of our contractual obligations is prevented or affected by ‘force majeure’. In these Terms and Conditions, ‘force majeure’ means any event which we could not, even with due care, foresee or avoid. Such events may include, but are not limited to, war, threat of war, civil commotion or strife, hostilities, strikes or other industrial disputes, natural disasters, fire, acts of God, terrorist activities, quarantine, epidemics, weather conditions, government action or other events outside our control.

 

COMPLAINTS

 

In the unlikely event that clients have a complaint about the villa or its contents whilst on holiday, it must be reported immediately to Villa representative who will take reasonable steps to resolve the matter. The Villa Management shall have no liability for any complaint submitted after the completion of the hire period.  Subjective opinions are not considered as a complaint, for example complaining that the beds are not comfortable. This may be one person\’s opinion but not the opinion of someone else.  If a client chooses to leave a rental over a subjective issue he must take responsibility for his decision as no refund will be considered in this situation.

No refund or rate adjustment shall be made for unforeseen mechanical failures such as the supply of electricity, water, internet, pool filtration systems, air conditioning, television or satellite service, appliances, etc. It is the client\’s obligation to report any problems or damage to their villa immediately.

JURIDICTION

 

Any contract that is made will be with the acceptance by both parties of these terms and conditions, which are governed by the local law of the property rented and both parties will submit to the exclusive jurisdiction of the local courts of the property rented.
